This Creator Program Privacy Notice explains how Kuiper Ventures LLC, doing business as EverSnug (“EverSnug,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information in connection with EverSnug creator applications and creator opportunities.

1. Scope

This notice applies to information submitted through the EverSnug creator application, information generated through our review and communications, and information associated with TikTok Shop creator campaigns, samples, and affiliate participation. A platform such as TikTok or Shopify processes information under its own privacy terms when you use that platform.

2. Information we collect

Depending on how you interact with the program, we may collect:

  • Application information: email address, TikTok handle or profile URL, portfolio or content URLs, opportunity preference, TikTok Shop status, content categories, optional content ideas, eligibility attestations, commitments, consent selections, and application ID.
  • Creator and campaign information: communications, review notes, selection status, briefs, agreements, sample status, shipping information if separately requested after approval, deliverables, content links, disclosure checks, content approvals, usage permissions, campaign performance, commission or payment information, and compliance records.
  • Device and attribution information: page path, referral or campaign parameters, form interactions, approximate device/browser information, cookies, pixels, and similar analytics data used by our storefront and service providers.
  • Information from third parties: publicly available creator content and profile information; information made available by TikTok Shop or another platform; and information provided by agencies, service providers, or people authorized by you.

Do not submit sensitive personal information, government identifiers, tax information, bank details, passwords, or a shipping address through the creator application. If those details are needed after approval, we will request them through an appropriate channel.

3. How we use information

We may use creator information to:

  • receive, validate, review, score, route, and respond to applications;
  • assess eligibility, content fit, platform status, campaign needs, safety, and compliance;
  • contact creators and administer samples, briefs, affiliate invitations, agreements, content review, payments, and creator support;
  • operate, measure, secure, troubleshoot, and improve the application funnel and creator program;
  • attribute applications to recruitment campaigns and evaluate program performance;
  • detect spam, fraud, abuse, policy violations, security incidents, or misuse of samples and commissions;
  • maintain records, resolve disputes, enforce agreements, and comply with legal, tax, accounting, safety, or platform obligations; and
  • send optional creator marketing emails when you have separately opted in.

4. How we disclose information

We may disclose creator information as reasonably necessary to:

  • Service providers and agencies that support our Shopify storefront, form processing, customer relationship management, email, analytics, recruitment, campaign operations, fraud prevention, content review, shipping, payment, legal, accounting, or information-security functions. They may use information only to provide services to us or as permitted by their agreements and applicable law.
  • Platforms and campaign partners such as TikTok Shop when necessary to verify eligibility, send an invitation, administer affiliate participation, measure performance, investigate compliance, or operate an agreed campaign.
  • Professional advisers and authorities when reasonably necessary to comply with law, respond to valid legal process, protect rights or safety, prevent fraud or abuse, or establish, exercise, or defend legal claims.
  • Business transaction recipients in connection with a proposed or completed financing, merger, acquisition, reorganization, sale of assets, or similar transaction, subject to appropriate safeguards.

We do not sell creator application information for money. Some website analytics or advertising technologies may be treated as “sharing,” “targeted advertising,” or a “sale” under certain U.S. state privacy laws even when no money changes hands. You may contact us to exercise applicable opt-out rights.

5. Marketing choices

Operational messages about an application or creator opportunity are separate from marketing. We send creator marketing email only when you select the separate marketing option or otherwise provide valid consent. You can unsubscribe using the link in a marketing email or by contacting us. Unsubscribing from marketing does not stop necessary operational communications about an active application, sample, agreement, or payment.

6. Cookies and analytics

Our storefront and providers may use cookies, pixels, local device technologies, and event data to operate the page, remember preferences, prevent abuse, measure application steps, understand campaign attribution, and evaluate advertising. Browser and device controls may limit certain technologies, but disabling them can affect page functionality. We do not include your email, TikTok handle, portfolio URL, or content idea in Shopify custom analytics event payloads generated by the creator application.

7. Retention

We retain creator information for as long as reasonably necessary for the purposes described in this notice, including application review, future creator opportunities, active campaigns, relationship management, fraud prevention, recordkeeping, legal compliance, and dispute resolution. Retention varies based on the information, whether you were selected, whether a campaign or payment remains active, and applicable legal or platform requirements. We delete or de-identify information when it is no longer reasonably needed, unless retention is required or permitted by law.

8. Security

We use reasonable administrative, technical, and organizational measures designed to protect creator information. No internet transmission or storage system is completely secure, so we cannot guarantee absolute security. Do not send passwords, government identifiers, tax forms, or bank information through ordinary email or the creator application.

9. Your privacy rights

Depending on where you live and subject to legal exceptions, you may have the right to request access to, correction of, deletion of, or a portable copy of personal information; obtain information about categories of collection and disclosure; opt out of certain targeted advertising, sale, or sharing; limit certain processing; withdraw consent; or appeal a denied privacy request. You will not be discriminated against for exercising an applicable privacy right.

Submit a request to help@eversnug.com with the subject “Creator Privacy Request.” We may need to verify your identity and authority before completing a request. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and direct verification with you.

10. International processing

EverSnug and its service providers may process information in the United States and other countries where they operate. Privacy laws in those locations may differ from those where you live. Where required, we use appropriate safeguards for cross-border transfers.

11. Age restriction

The creator program is for adults age 18 or older and is not directed to children. If we learn that a person under 18 submitted an application, we may delete it and stop the application process.

12. Changes to this notice

We may update this notice to reflect changes to the program, technology, providers, or law. We will post the updated notice with a revised effective date and provide additional notice when required.
